Please read our complete terms and conditions carefully. By engaging in any of the following actions, you are deemed to have accepted these terms:

  • Acceptance by an authorised signatory.
  • Sending an acceptance via email from an authorised signatory.
  • Making payment for any treatment, consultation, product, or service.
  • Attempting payment through any means, whether or not the payment is successful.
  • Utilising RT Aesthetics services, including but not limited to calling us, submitting your details on our website, visiting our website, emailing us, visiting our clinic, corresponding with us in writing, or engaging with us on our social media platforms.
  • Booking any service with us, thereby becoming a client of RT Aesthetics.

Booking Process: We accept bookings by phone and through our online booking system. To secure your booking (client), we require your full name, contact number, and email address. If you provide an email address, you will receive a booking confirmation. Please promptly notify us of any changes to your contact details.

Pre-Appointment Forms: Before your appointment, we will send you text messages containing forms that must be completed before your clinic visit. These forms are essential and must be filled out before attending the clinic. They are sent 48 hours before your appointment via text message. If you have booked within 48 hours of your appointment, they may not be sent until the day of your appointment.

Consultation Appointments: Face-to-face consultation appointments are charged at £20, which will be taken upon booking to secure your consultation. This payment is non-refundable.

Deposit Payment for Treatments: A deposit payment is required to book any treatment, and it will be collected at the time of booking via card payment. All deposits are non-refundable.

Appointment Confirmation: We will confirm your appointment by email.

Reminder Notifications: An appointment reminder SMS will be sent to you 48 hours before your appointment, and an email reminder will be sent 72 hours before your appointment.

Rescheduling and Cancellation Policy:

We place great importance on your appointments at RT Aesthetics Ltd. Each appointment is specially reserved for you, and while we recognise that occasional scheduling changes may be required, we kindly ask for a minimum of 48 hours’ notice for cancellations. Please appreciate that when you forget or cancel your appointment without adequate notice, it not only leaves a gap in our schedule but also denies clients on our waiting list the chance to benefit from our services.

  • Any appointment must be rescheduled with a minimum of 48 hours notice.
  • Deposit payments will be forfeited in full should you choose to cancel your appointment for any reason.
  • Cancellation within 48 hours, non-attendance, or late arrival will incur a charge of 100% of the service booked.
  • We will retain card details provided during booking to charge any fees if you fail to attend, cancel with less than 48 hours notice, or arrive late to your appointment. More terms and conditions regarding this can be found under our ‘Consent to Use Saved Card Details for Payment‘.

Clinic Terms

Late Arrival Policy: If you are more than 10 minutes late for an appointment, please be aware this may result in your appointment being cancelled and you being charged 100% of the service booked.

Rescheduling and Package Deduction: Treatment packages cancelled with less than 48 hours’ notice, late arrival, or no-shows will be deducted from the total package or charged at full price.

Special Offers: Special offers require full payment upon booking and are non-refundable. These offers cannot be applied to pre-existing bookings.

Price Matching: Price matching is subject to local clinics only. Evidence must be provided through an official price chart, a clear and obvious picture, or an official website link at our reception desk. We reserve the right to reject price-matching requests if deemed inequitable towards our business.

No-Show Policy No-shows will be charged 100% of the reserved service amount taken from the card used for booking.

Refund Policy: Fees charged for treatment are for the treatment delivery and associated services. All treatments, services, packages, courses, and products are non-refundable. Exceptions apply only in cases of a serious or long-term illness confirmed by a medical certificate within 48 hours of notification.

Treatment Validity: All courses of treatment are valid for nine months from the date of purchase/deposit payment. Treatment packages are valid for 12 months from the purchase/deposit payment date. Once a package expires, no refunds will be given. If you choose not to continue treatment, you will lose the cost of that package.

Gift Vouchers: Gift vouchers are non-refundable, valid for 12 months from purchase, and must be presented when booking. Late cancellation and “failure to show” terms also apply to gift vouchers.

Email Disclaimer: The contents of our emails are confidential and intended solely for the addressee. Any unauthorised use, disclosure, or reliance on the information herein is prohibited. We are not responsible for errors or omissions in email messages.

Price Alteration: We reserve the right to alter prices without prior notice.

Payments: By providing and storing your credit card information, you authorise us to charge your card for outstanding invoices. Payments are non-refundable once made.

Data Security: Personal details are kept confidential and safe during consultation procedures. Refer to our privacy policy for more details.

Medical Conditions: Please inform your practitioner of any medical conditions before booking.

Mobile Phones: Please refrain from using mobile phones during your time at the clinic.

Children: Children under 18 are not accommodated at our clinic.

Personal Items: Ensure you retrieve all your items before leaving as we cannot be held responsible for lost items.

Consent to Use Saved Card Details for Payment

By booking any service or providing your payment card details to RT Aesthetics Ltd, you expressly consent to the following terms and conditions:

  1. Authorisation: You authorise RT Aesthetics Ltd to use the payment card details you provide for the purpose of processing payments for any charges, fees, or costs associated with the services and products offered by RT Aesthetics Ltd, including but not limited to treatment fees, consultation fees, and any other charges incurred.
  2. Stored Card Details: RT Aesthetics Ltd will securely store the payment card details provided by you at the time of booking. These details will be stored in compliance with applicable data protection laws and industry standards to ensure the security and confidentiality of your information.
  3. Payment Deductions: You acknowledge and agree that RT Aesthetics Ltd may use the stored payment card details to charge your card for the payment of any fees, charges, or costs incurred in connection with the services or products you have booked or received.
  4. Notification: RT Aesthetics Ltd will make reasonable efforts to notify you in advance of any payment to be deducted from the stored card details. This notification may include but is not limited to email correspondence and billing statements.
  5. Responsibility: It is your responsibility to ensure that the payment card details provided are accurate and up to date. You are also responsible for keeping your card details valid and for promptly notifying RT Aesthetics Ltd of any changes to your card information.
  6. Dispute Resolution: In the event of any dispute regarding charges made using the stored card details, you agree to contact RT Aesthetics Ltd promptly to resolve the matter. Any disputed charges will be handled in accordance with our standard dispute resolution procedures.

Payment Dispute Resolution Procedures

At RT Aesthetics Ltd, we are committed to providing our services while adhering to UK law and regulations. To ensure transparency and protect our business interests, we have established the following detailed payment dispute resolution procedures:

1. Contacting Us: If you have concerns, queries, or disputes regarding charges on your payment card, it is imperative that you promptly contact our customer support team using the official contact details provided on our website. Your prompt communication allows us to address the matter efficiently.

2. Informal Resolution: We are dedicated to resolving payment disputes amicably and directly with you. We firmly believe that most payment disputes can be successfully resolved through open and transparent communication. Our commitment is to work diligently with you to find a fair and just solution.

3. Formal Dispute Resolution: In situations where an informal resolution is not feasible or when further investigation is warranted, we may initiate a formal dispute resolution process. This formal procedure may involve collecting comprehensive information, conducting thorough investigations, and engaging with relevant parties to reach a just and equitable resolution.

4. Charge for Fraudulent or Unauthorized Disputes: In the event that you initiate a payment dispute that is subsequently determined to be fraudulent or unauthorized by RT Aesthetics Ltd, the following terms and conditions apply:

4.1. Dispute Handling Fee: RT Aesthetics Ltd retains the right to charge a handling fee of £200 plus VAT for any payment dispute found to be fraudulent or unauthorized. This fee is intended to recover the administrative and investigation costs incurred by our business as a result of such disputes.

4.2. Fraudulent Disputes: A fraudulent payment dispute is defined as a dispute made without a valid reason, with the intention to evade payment for services or products that have been legitimately received from RT Aesthetics Ltd. Fraudulent disputes may also encompass disputes initiated without adhering to the agreed-upon payment dispute resolution procedures.

4.3. Unauthorized Disputes: An unauthorized payment dispute refers to a dispute initiated without proper authorization or in contravention of the terms and conditions agreed upon when booking services with RT Aesthetics Ltd.

4.4. Resolution of Fraudulent or Unauthorized Disputes: Upon your initiation of a payment dispute, should RT Aesthetics Ltd determine the dispute to be fraudulent or unauthorized, you will be duly notified of the outcome. The handling fee will be charged to your account. Additionally, we reserve the right to take further legal action, as required, to recover the disputed amount.

By accepting these terms and conditions, you confirm that you understand and agree to the payment dispute resolution procedures outlined above, including the handling fee for fraudulent or unauthorized disputes. Our objective is to ensure compliance with UK law, maintain transparency, protect our business interests, and uphold fair and equitable business practices. Refund Policy

At RT Aesthetics Ltd, we want to ensure clarity and compliance with UK law regarding our refund policy. Please read the following refund policy which outlines the terms for fees charged for our services and products:

1. Fees for Treatment: The fees charged for our treatment services encompass the delivery of the treatment itself, along with accompanying services, which include:

  • Consultation and assessment
  • Provision of information and advice
  • Safe treatment using evidence-based products
  • Follow-up appointments and aftercare advice and support as deemed appropriate

While we are dedicated to providing excellent service, offering factual, honest, and ethical advice, ensuring safe treatment by experienced professionals, and using premium products, it’s essential to understand that we cannot guarantee specific results. Consequently, we do not offer refunds if the results achieved fall short of your expectations.

2. Services: All treatments, services, packages, courses, and products purchased at our clinic are non-refundable. This policy is in line with our commitment to transparency and consistent service standards.

3. Deposit Payments: Deposit payments are non-refundable if you choose to cancel your appointment for any reason. This ensures that we can effectively manage our schedule and accommodate clients who seek our services.

4. Treatments in Progress: Treatments that have already taken place will not be eligible for refunds under any circumstances. We are dedicated to maintaining the integrity of our services and their associated fees.

5. Exception for Medical Contradiction: The only exception to our refund policy is in cases of a severe or long-term illness that contraindicates the treatment. This must be confirmed by a medical certificate within 48 hours of notifying us of the medical issue. If the treatment has not yet started or the client has treatments remaining within a treatment package, RT Aesthetics Ltd will issue a refund, deducting the cost of the services provided at the total price and applying our refund administration charge of £200+VAT.

6. Treatment Timeframes: All courses of treatments must be utilised within nine months of purchase, and all packages of treatments must be utilised within twelve months of purchase. This is to ensure that services and appointments are efficiently scheduled and delivered.

7. Gift Vouchers: Gift vouchers must be redeemed within twelve months from the date of purchase or within the timeframe specified on the gift voucher itself. Please note that standard cancellation and “no-show” terms also apply to gift vouchers.

8. Products: For products purchased at our clinic or an event, refunds are not applicable. However, if you purchased a product online, you can return it within 28 days of purchase, following the RT Skin terms and conditions, which are available at www.rtskin.co.uk.

9. Treatment Packages

  • All courses of treatments are valid for nine months from the date of purchase/deposit payment.
  • All treatment packages are valid for twelve months from the purchase/deposit payment date.
  • If the package expires and/or you decide not to continue treatment, no refund will be given.
  • If you no longer want to attend the clinic for your treatment, you will lose the cost of that package.

3. Non-Disclosure of Medical Conditions: Should you fail to disclose any medical conditions that may impede your ability to undergo the treatment(s), we reserve the right to decline treatment(s) and charge you in full for the cancellation. This charge encompasses the cost of the treatment and/or the consultation, where applicable.

Treatment Suitability

Our commitment extends to a thorough evaluation of a treatment’s suitability for you and its likelihood of success before any administration. In situations where, following this assessment, we ascertain that the treatment is not suitable for you, we will expeditiously communicate the reasons, using the medium of an in-person consultation, email, or postal correspondence. In such cases, your responsibility will be confined solely to the cost of the initial consultation, where applicable.

Liability

In compliance with UK law and for the protection of our business, we underscore the following terms related to liability:

  • RT Aesthetics shall not be liable, whether under contract, tort, or any other legal framework, for any economic loss, including, but not limited to, loss of profit, or for any other consequential, indirect, or special loss or damage arising in connection with the provision of goods and/or services to the client.
  • The client is obligated to provide RT Aesthetics with their comprehensive medical history and details of any pre-existing medical conditions prior to each treatment.
  • RT Aesthetics absolves itself of liability for any damage, including personal injury, that may result from the client’s failure to disclose pertinent medical information.
  • By undergoing treatment, the client commits to adhering to all instructions and recommendations provided by or on behalf of RT Aesthetics concerning the care of the treated area.
  • These business terms do not serve to exclude or limit RT Aesthetics’ liability for death or any personal injury resulting from negligence on the part of RT Aesthetics.

RTA Maintenance Membership T&CS

Provider: RT Aesthetics Ltd, a company registered in England, with a registered office on the First Floor, The Knowles, Front Street, Whickham, NE16 4SN, from now on referred to as the “Provider.”

Member: Details are given at the beginning of this contract

1. Membership Description

1.1 The RTA Maintenance Membership (“Membership”) enables members to access a range of skincare and aesthetic treatments provided by RT Aesthetics Ltd (“the Clinic”) through the purchase of monthly membership packages.

1.2 Members may select from various membership tiers, each with a designated monthly fee and corresponding services. Specific details regarding services included in each tier will be provided to the member upon enrollment.

2. Membership Term

2.1 The Membership term shall commence upon enrollment and continue for an initial period of 12 months from the Effective Date of this Agreement. This agreement cannot be canceled until the end of the 12-month term, at which point it will automatically cancel itself.

2.2 Following the initial 12-month period, the Membership shall not renew automatically. Upon completion of the 12-month term, the Member may choose to rejoin and sign a new agreement if they wish to continue their Membership benefits.

3. Payment and Benefits Allocation

3.1 Members agree to make monthly payments to access Membership benefits. The cost of each membership tier and payment details will be outlined above under the Payment Terms and apply to the membership they signed up for on ChargeBee.

3.2 Membership benefits, including treatments and discounts, are allocated to the member’s account each month based on the selected membership tier.

3.3 Payments are to be made according to the payment methods and schedules specified in the signup form when making payment.

3.4 Membership benefits, such as treatments and discounts, hold no cash value and can only be redeemed for products or services offered by RT Aesthetics Ltd.

4. Changes to Terms and Conditions

4.1 RT Aesthetics Ltd reserves the right to modify or terminate these terms and conditions or the Membership program itself at any time. Members will be notified in writing of any such changes.

5. Entire Agreement

5.1 This Agreement constitutes the entire agreement between the Provider and the Member and supersedes all prior agreements, understandings, and representations, whether oral or written.

6. Identification and Appointment Booking

6.1 To complete the membership enrollment process, the Member must provide photographic identification, such as a driver’s license or passport, to confirm their identity. Additionally, the Member’s information will be verified through banking software.

6.2 Advanced Booking for Preferred Appointments: Members are encouraged to schedule treatments well in advance, especially during peak periods. Booking treatments in advance allows Members to secure preferred appointment slots.

7. Missed Appointments

7.1 Failure to attend a pre-booked treatment without providing at least 48 hours’ notice of cancellation or rescheduling will result in a charge of 100% of the appointment cost, to be deducted from the Member’s debit/credit card on file.

8. Payment Authorization and Debt Collection

8.1 Payment Authorization: Upon enrollment in the membership, the Member explicitly authorizes the Provider to securely store their card details and direct debit information for payment processing purposes.

8.2 Resolution of Payment Failures: In the event of a payment failure, the Provider reserves the right to charge the remaining balance for the membership fee from the saved card on file.

8.3 Full Payment Collection: In case of defaulted payments, the full payment for the remaining term, whether it be the full 12-month period or any remaining months, will be charged in full using the card on file. Despite payment issues, the Member will continue to receive benefits until the end of the agreed-upon membership period.

8.4 Debt Collection for Persistent Payment Issues: If payment issues persist beyond the initial resolution attempts, the Provider reserves the right to engage a debt collection agency to recover the outstanding debt. In compliance with applicable laws and regulations, this agency will undertake the necessary actions to recover the outstanding debt on behalf of the Provider.

8.5 Administration Fee for Payment Failures: In the event of a payment failure, a £25 administration fee will be added to the Member’s account.

This comprehensive approach ensures that both the Member and the Provider can maintain the integrity of the membership program while addressing any payment challenges that may arise during the course of the agreement.

9. Membership Activation

9.1 The Member’s membership shall commence upon the successful processing of the first payment.

10. Membership Upgrade and Downgrade

10.1 After the initial 12-month commitment, the Member may upgrade their membership to a higher plan once per year with an updated agreement. Downgrading of the membership during the year is not permitted.

11. Membership Changes and Termination

11.1 The Provider reserves the right to make changes to the Membership program, its benefits, or the points allocation at any time. Members will be notified of any significant changes in writing.

11.2 The Provider may terminate the Membership or the points allocation with a 30-day notice. However, termination by the Member before the end of the 12-month term is not permitted. Membership will automatically cancel itself at the end of the 12-month term, at which point the Member may choose to rejoin and sign a new agreement if they wish to continue their Membership benefits.

12. Member Responsibilities

12.1 Members are responsible for managing their Membership, scheduling appointments, and updating their contact details and payment information.

12.2 Members are required to abide by the Provider’s policies and guidelines related to Membership.

13. Electronic Signature

13.1 The parties acknowledge that electronic signatures or acceptance through digital means are legally binding and acceptable for this Agreement.

14. Cooling-Off Period

14.1 The Member has a cooling-off period of 14 days from the Effective Date of this Agreement during which they may cancel their membership without penalty.

14.2 If the Member exercises their right to cancel within the cooling-off period, they will receive a full refund of any membership fees paid.

14.3 However, if the Member uses any of the membership benefits or receives cashback within the cooling-off period, their right to cancel without penalty will be forfeited.

15. Joining Fees

15.1 In addition to the membership fees outlined in Section 2, the Member agrees to pay a one-time joining fee of £299 upon enrollment into the RTA Maintenance membership. Unless they are an RTA VIP Memmeber, they will get an applicable discount as listed in Section 2.

16. Force Majeure

16.1 In the event of unforeseen circumstances or events beyond the control of either party, such as natural disasters, acts of terrorism, or government actions, this Agreement may be temporarily suspended or terminated as deemed necessary by the Provider. The Provider and Member will handle their respective obligations as per the circumstances.

17. Data Protection and Privacy

17.1 The Provider will process the Member’s personal data in compliance with applicable data protection and privacy laws. Details of data processing purposes and the Member’s data rights can be found in the Privacy Policy.

18. Severability

18.1 If any part of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Notices

19.1 Any notices or communications required under this Agreement shall be made in writing and delivered to the respective party’s contact information provided in this Agreement.

20. Amendments

20.1 The Provider reserves the right to amend the terms and conditions of this Agreement when necessary. Amendments may be made for reasons including, but not limited to, regulatory changes, enhancements to the membership program, or improvements in service delivery.

20.2 In the event of amendments to this Agreement, the Provider will provide written notice to all members at least 30 days prior to the effective date of the changes. Notice may be delivered through electronic communication, postal mail, or other appropriate means.

20.3 Members shall be deemed to have consented to the amendments unless they provide written notice of their intent to terminate their membership within 30 days following the receipt of the notice of amendments.

21. Member Conduct

21.1 Members are expected to conduct themselves in a respectful and considerate manner at all times when participating in the membership program. This includes interactions with other members, staff, and service providers.

21.2 Members are required to comply with all policies and guidelines established by the Provider related to the membership program. Failure to adhere to these policies may result in termination of membership, and the Member will still be liable for all and any fees outstanding on the membership.

21.3 Members shall refrain from making derogatory, disparaging, or harmful statements or comments about the Provider, its staff, or other members in any public or private forum.

22. Liability Limitation

22.1 The Provider shall not be liable for any injuries, damages, losses, or claims arising out of or related to the provision of treatments, events, or other membership benefits, unless such liabilities result from gross negligence or willful misconduct.

22.2 Members are responsible for their own well-being and safety during treatments, events, or other membership activities. The Provider shall not be held liable for any injuries or damages resulting from a member’s failure to adhere to instructions, guidelines, or recommendations provided.

23. Force Majeure

23.1 “Force Majeure Event” refers to any event or circumstance beyond the reasonable control of the Provider or the Member, including but not limited to acts of God, war, terrorism, strikes, natural disasters, governmental actions, and pandemics.

23.2 In the event of a Force Majeure Event that prevents either party from fulfilling its obligations under this Agreement, the affected party shall promptly notify the other party of the occurrence of such an event and its expected duration.

23.3 During the Force Majeure Event, the affected party’s obligations under this Agreement may be temporarily suspended, except for the payment obligations mentioned in Section 2. In other words, the Member remains obligated to make payments as specified in Section 2, even during a Force Majeure Event.

23.4 If a Force Majeure Event continues for a period of 3 months, either party may terminate this Agreement by providing written notice to the other party. In such a case, the Member shall not be entitled to any refund of membership fees paid, but the payment obligations in Section 2 shall remain in effect.

27. Refund Policy

27.1 The Provider maintains a strict no-refund policy. Members acknowledge and agree that all payments, including joining fees and monthly membership fees, are non-refundable.

27.2 Exceptions to this policy are not available under any circumstances, including but not limited to Membership cancellation, early termination, or non-utilization of benefits.

27.3 Members are encouraged to review their Membership carefully before enrolling, as once payment is made, it is considered final and non-refundable.

27.4 Payments must be made throughout the 12-month agreement, and all are non-refundable.

28. Dispute Resolution

28.1 In the event of a dispute between the Member and the Provider relating to the Membership or its benefits, both parties agree to first attempt to resolve the issue through good-faith negotiations.

28.2 If the dispute remains unresolved after negotiations, either party may elect to pursue mediation or arbitration as an alternative means of resolution. The party wishing to initiate mediation or arbitration must provide written notice to the other party.

28.3 Mediation: If mediation is chosen, both parties agree to select a mutually acceptable mediator and share the associated costs equally. The mediation process will take place at a location agreed upon by both parties.

28.4 Arbitration: If arbitration is chosen, it shall be conducted in accordance with the rules and procedures of a recognized arbitration institution agreed upon by both parties. The arbitrator’s decision shall be binding and enforceable in a court of law.

29. Termination by Member

29.1 Members may terminate their Membership at any time by providing written notice to the Provider. The notice should be sent to the contact information provided in this Agreement.

29.2 Termination Fees: Members acknowledge that, due to the non-refundable nature of payments, no refunds are issued upon termination. Members remain responsible for any fees associated with the termination. In the event of termination before the end of the 12-month term, the Member shall be liable for all fees and charges due under the Agreement until the end of the 12-month term.

30. Termination by Provider

30.1 The Provider reserves the right to terminate a Member’s Membership under the following circumstances:

(a) Failure to make monthly payments, which remain unpaid for 30 days beyond the payment due date.

(b) Violation of the Membership Code of Conduct, as outlined in Section 22.

(c) Any form of harassment, discrimination, or inappropriate behavior towards other Members, staff, or service providers.

30.2 Notice of Termination: In cases where the Provider determines that termination is necessary, the Member will receive written notice of the termination and the reasons for it.

30.3 Consequences of Termination: Termination of Membership will result in the forfeiture of all unused benefits and points. Any outstanding fees or costs owed by the Member will remain due and payable.

31. Non-Transferability

31.1 Membership is non-transferable and non-assignable. Members may not share, sell, gift, or otherwise transfer their Membership, benefits, or points to another person.

32. Indemnification

32.1 Responsibilities: Each party agrees to indemnify, defend, and hold harmless the other party and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to any breach of this Agreement or violation of applicable laws or regulations.

33. Confidentiality

33.1 Protection of Confidential Information: Both parties agree to treat all information exchanged during the membership, including but not limited to business information, customer data, and trade secrets, as confidential. They shall not disclose such information to any third party without the prior written consent of the disclosing party, except as required by law.

34. Disclaimers

34.1 Results Disclaimer: The Provider makes no guarantees, representations, or warranties regarding the results of treatments or services provided under the Membership. Results may vary depending on individual factors, and the Provider cannot guarantee specific outcomes.

34.2 Limitation of Services: The Provider reserves the right to refuse or limit services under the Membership based on individual suitability, medical considerations, or other factors deemed relevant by the Provider.

34.3 Risks Involved: Members acknowledge and accept the potential risks associated with skincare and aesthetic treatments, including but not limited to allergic reactions, skin sensitivity, and unforeseen complications. Members agree to undergo treatments at their own risk and hold the Provider harmless for any adverse effects.

35. Cancellation Policy

35.1 Cancellation Overview: While the agreement cannot be canceled until the end of the 12-month term, members may request cancellation by providing written notice to the Provider. However, no refunds will be issued for the remaining term of the agreement.

35.2 Penalties or Fees: In the event of early termination, members remain liable for all fees and charges due under the Agreement until the end of the 12-month term. Additionally, a penalty fee may be applied as outlined in Section 8.5 of this Agreement.

RTA VIP+ Membership Agreement

This Membership Agreement (“Agreement”) is entered into on the date above (“Effective Date”) between:

Provider: RT Aesthetics Ltd, a company registered in England, with registered office at First Floor, The Knowles, Front Street, Whickham, NE16 4SN, hereinafter referred to as the “Provider.”

Member: Details are given at the beginning of this contract

1. Membership Term

1.1 The Membership term shall be for a period of 12 months, commencing from the Effective Date of this Agreement.

1.2 The Member must provide a minimum of 30 days’ written notice before the end of the 11th month of their 12-month membership term if they wish to terminate the membership. Failure to provide such notice will result in the automatic renewal of the contract for another 12 months.

2. Payment

2.1 The Member agrees to make payments for the membership via direct debit through GoCardless or recurring card payment through Stripe. Detailed payment information can be found under “Payment Information.”

2.2 In the event of a payment default, the Member shall be subject to a £25.00 administration fee for handling the consequences of each payment default. This fee represents a reasonable estimate of the administration costs incurred by the Provider.

2.3 In accordance with UK law, if the Member cancels or fails to pay, the debt may be passed onto a debt collection agency, and interest of 8% per annum may be charged on the outstanding amount.

2.4 In the event of a payment default or failure to pay for your membership, any cashback or benefits you earned and used during your membership will become payable and will be charged accordingly. This includes any outstanding membership fees, administration costs, discounts, referral fees, birthday credit and any and all benefits.

3. Membership Benefits

3.1 As a valued Member, you are entitled to enjoy the following exclusive benefits:

  • Biannual Skin Analysis.
  • £50 Birthday Credit.
  • £50 Credit for Every Referral.

3.2 Cashback benefits, including those mentioned in clause 3.1, are subject to availability and may not be applicable to all services.

3.3 Cashback earned on treatments will be added to the Member’s treatment account within 24 hours after the completion of the treatment.

3.4 The cashback accumulated in the Member’s treatment account can be redeemed as full or part payment for future treatments. However, it cannot be used in conjunction with receiving further cashback or any offers or promotions.

3.5 Cashback benefits, as mentioned in clause 3.1, are subject to availability and may not be applicable to all services or products.

3.6 In the event of membership cancellation, whether voluntarily by the Member or due to a breach of this Agreement, all membership benefits, including any cashback, shall be forfeited.

3.7 If a Member chooses to rejoin after cancelling their membership, cashback benefits will only apply to the new membership term and its respective terms and conditions. No cashback from a previous membership may be added back to their treatment account.

3.8 Only the Member can use the benefits and cashback; this cannot be transferred to anyone else.

3.9 The Member is eligible to receive a £50 credit for every referral to the RTA VIP+ membership.

3.10 To qualify for the referral credit, the referred person must successfully join the RTA VIP+ membership and complete the required first payment and contract.

3.11 Once the referred person has met the conditions mentioned in clause 3.10, the Member’s treatment account will be credited with £50 for each successful referral.

4. Changes to Terms and Conditions

4.1 The Provider reserves the right to alter these terms and conditions or withdraw the membership scheme at any time. The Member will be notified in writing of any such changes.

5. Entire Agreement

This Agreement constitutes the entire agreement between the Provider and the Member and supersedes all prior agreements, understandings, and representations, whether oral or written.

6. Identification and Appointment Booking

6.1 To complete the membership enrollment process, the Member must furnish photographic identification, such as a driver’s license or passport, to confirm their identity. Additionally, the Member’s information will be verified through banking software. These steps are essential to uphold the security and integrity of the membership program.

6.2 Advanced Booking for Preferred Appointments: The Provider encourages Members to plan and schedule their treatments well in advance, particularly during peak periods or high-demand times. Booking treatments in advance allows Members to secure preferred appointment slots that best fit their schedules and preferences. By doing so, Members can ensure that they have access to the services they desire when they need them most, enhancing their overall experience as valued members.

7. Missed Appointments

7.1 Failure to attend a pre-booked treatment without providing at least 48 hours’ notice of cancellation or rescheduling will result in a charge of 100% of the appointment cost, to be deducted from the Member’s debit/credit card on file.

8. Payment Authorization and Debt Collection

8.1 Payment Authorization: Upon enrollment in the membership, the Member explicitly authorizes the Provider to securely store their card details and direct debit information for payment processing purposes.

8.2 Resolution of Payment Failures: In the event of a payment failure, the Provider reserves the right to charge the remaining balance for the membership fee from the saved card on file.

8.3 Full Payment Collection: In case of defaulted payments, the full payment for the remaining term, whether it be the full 12-month period or any remaining months, will be charged in full using the card on file. Despite payment issues, the Member will continue to receive benefits until the end of the agreed-upon membership period.

8.4 Debt Collection for Persistent Payment Issues: If payment issues persist beyond the initial resolution attempts, the Provider reserves the right to engage a debt collection agency to recover the outstanding debt. In compliance with applicable laws and regulations, this agency will undertake the necessary actions to recover the outstanding debt on behalf of the Provider.

8.5 Administration Fee for Payment Failures: In the event of a payment failure, a £25 administration fee will be added to the Member’s account.

This comprehensive approach ensures that both the Member and the Provider can maintain the integrity of the membership program while addressing any payment challenges that may arise during the course of the agreement.

9. Membership Activation

9.1 The Member’s membership shall commence upon the successful processing of the first payment. Membership benefits shall only be accessible after the initial payment has been made.

10. Membership Upgrade and Downgrade

10.1 The Member may upgrade their membership to a higher plan at any time during the 12-month term with an updated agreement. Downgrading of the membership during the 12-month term is not permitted.

11. Discounts and Promotions

11.1 Limitations on Discounts: Discounts extended to Members for treatments and skincare products are subject to certain limitations. These discounts cannot be combined or used simultaneously with any other ongoing offers or promotions unless expressly and explicitly stated otherwise.

11.2 Preservation of Offers: This restriction is in place to ensure the preservation of the unique and exclusive benefits provided to Members as part of the RTA VIP+ membership program. By maintaining the exclusivity of these discounts, the Provider aims to deliver exceptional value and specialized advantages to its Members, enhancing their overall experience.

11.3 Transparent Communication: In cases where a discount or promotion can be used in conjunction with other offers, the Provider will communicate this clearly and explicitly to the Member to provide full transparency and enable them to make the most informed decisions regarding their benefits and savings.

12. Termination for Cause

12.1 The Provider may terminate the membership for cause if the Member breaches any terms of this Agreement. Termination for cause does not require a 30-day notice and may result in immediate cessation of membership benefits.

12.2 In the event of termination for cause as described in Section 12.1, the Member will remain liable for all charges for the remainder of the agreement, and no refunds will be issued for any unused portion of the membership term.

13. Cooling-Off Period

13.1 The Member has a cooling-off period of 14 days from the Effective Date of this Agreement during which they may cancel their membership without penalty.

13.2 If the Member exercises their right to cancel within the cooling-off period, they will receive a full refund of any membership fees paid.

13.3 However, if the Member uses any of the membership benefits or receives cashback within the cooling-off period, their right to cancel without penalty will be forfeited.

14. Joining Fees

14.1 In addition to the membership fees outlined in Section 2, the Member agrees to pay a one-time joining fee of £4.99 upon enrollment into the RTA VIP+ membership.

15. Replacement Metal VIP Cards

15.1 If the Member requires a replacement for their Metal VIP Members Card, they may request one from the Provider. This can be done via email or phone.

15.2 A replacement Metal VIP Card will be provided to the Member at a cost of £25. This fee covers the cost of producing and issuing the replacement card.

By signing below, the Member acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Membership Agreement, including the provisions related to the cooling-off period.

16. Force Majeure

16.1 In the event of unforeseen circumstances or events beyond the control of either party, such as natural disasters, acts of terrorism, or government actions, this Agreement may be temporarily suspended or terminated as deemed necessary by the Provider. The Provider and Member will handle their respective obligations as per the circumstances.

17. Data Protection and Privacy

17.1 The Provider will process the Member’s personal data in compliance with applicable data protection and privacy laws. Details of data processing purposes and the Member’s data rights can be found in the Privacy Policy.

18. Severability

18.1 If any part of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

19.1 This Agreement constitutes the entire agreement between the Provider and the Member and supersedes all prior oral or written agreements.

20. Electronic Signature

20.1 The parties acknowledge that electronic signatures or acceptance through digital means are legally binding and acceptable for the Agreement.

21. Governing Law and Jurisdiction

26.4 Termination: If a Force Majeure Event continues for a period of 3 months, either party may terminate this Agreement by providing written notice to the other party. In such a case, the Member shall not be entitled to any refund of membership fees paid, but the payment obligations in Section 2 shall remain in effect.

27. Changes to Membership Benefits: The Provider reserves the right to modify or amend the membership benefits, including but not limited to the types of benefits offered, their availability, and the terms governing their use. Members will be notified of any significant changes to the membership benefits through written notice, which may include email communication or updates on the Provider’s official website. Members acknowledge and accept that the Provider’s offerings may evolve over time, and such changes do not constitute a breach of this Agreement.

28. Pricing Adjustments During the Minimum Term: The membership pricing may be adjusted during the minimum term of this agreement. Any pricing adjustments, if deemed necessary, will be communicated to members in advance, with at least 30 days written notice. Members are encouraged to review their membership agreement for the most current pricing information.

29. Termination by Member

29.1 Members may terminate their Membership at any time by providing written notice to the Provider. The notice should be sent to the contact information provided in this Agreement.
